One or both parties in a separating couple might own a closely held business, which may also be subject to valuation and division, or own assets in a trust. As an initial matter, it is important to characterize whether assets are “marital” or “non-marital” (or “separate”). Marital assets are subject to division by the Court, while non-marital assets are set apart to the owner.
 
Missouri law requires an equitable (fair) division of property between the spouses, whether determined by the Court or in an agreed-upon settlement.
